General Terms and Conditions for the Sale of a Single Experience

calabria-tour.it (“Tour Calabria,” “we,” “our”) is an online platform that allows you to purchase, either directly online or through our customer service, competitively priced tourism and leisure offers from qualified and reputable operators (hereinafter referred to as “Partners”) operating in the Calabria region.

On calabria-tour.it, you can also purchase travel packages and accommodation offers at selected hospitality establishments.

These general terms and conditions (hereinafter referred to as “General Conditions”) govern the use of our website calabria-tour.it (hereinafter referred to as the “Site”) by users, define our respective rights and obligations, and regulate the relationship between users of the Site who purchase an offer (hereinafter referred to as “Customers”) and the respective Partners of calabria-tour.it. We strongly recommend carefully reading the content of the General Conditions, as they apply to all our services available online, via email, or by phone. Therefore, calabria-tour.it requires you to declare that you have read, understood, and accepted the terms and conditions outlined below before proceeding with any purchase.

1. Service Description

The Site is an online platform that allows our Partners to advertise and sell their offers. You can purchase offers from our Partners by contacting our customer service or directly online—where available—using the Site’s e-commerce platform (hereinafter referred to as “Online Purchase”). In any case, by making a purchase, you enter into a legally binding sales contract directly with the Partner providing the offer. calabria-tour.it is solely responsible for managing the Site’s web pages, providing support to users before and during the purchase process, and operating the e-commerce platform. You can view the name of the Partner providing and selling the offer simply by registering on the Site. When you purchase an offer, we forward the details of your purchase to the relevant Partner and send you an email confirmation of the completed purchase.

2. Age Requirement

You declare that you are of legal age (at least 18 years old) and have the legal capacity to purchase offers, thereby fully accepting the content of the General Conditions.

3. How to Use the Offer and Partners’ Sales Conditions

calabria-tour.it includes on its web pages the specific sales conditions of the Partner providing and selling each offer. These conditions may relate, for example, to the location where the offer is provided, available times and slots, included services, cancellation policies, and other relevant details necessary for an informed purchase. It is your responsibility to review and accept the specific conditions of the Partner before completing a purchase.

By accepting these General Conditions, you declare that you have read and accepted the specific conditions applicable to the offer you have purchased.

The services included in the offers are provided in accordance with the details you provide during the purchase process and in compliance with the Partner’s sales conditions. The beneficiaries of the offer can be you or a designated recipient (e.g., if you are purchasing a gift). In the case of an Online Purchase, you can enter the recipient’s name directly on the Site; otherwise, you can communicate it to our customer service.

Partners may request, in addition to the unique purchase identification code (only for Online Purchases), the name of the purchaser or the recipient, along with valid identification to verify their personal identity. Similarly, Partners may require beneficiaries to present valid identification to confirm their age, if necessary.

If specific conditions are required by the Partner for the provision of an offer, these conditions will be detailed on the relevant offer’s page on the Site. The Partner may verify compliance with such conditions before delivering the service.

If an offer involves a high-risk activity that requires signing a liability waiver, the Partner may request the completion of this form before providing the service to the beneficiaries.

4. Purchase and Payment Process

On the Site, you will find the total price of each available offer, as well as any deposit required to complete the Online Purchase. The amount paid (either as a deposit or full price), whether through customer service or—when possible—directly online via our e-commerce platform, is collected by calabria-tour.it on behalf of the selling Partner. When requested, the invoice documenting the electronic payment is issued directly by the Partner.

Our customer service accepts electronic payments via PayPal. Unless otherwise specified in the Partner’s sales conditions, the remaining balance of the purchased offer must be paid directly to the Partner when you arrive to use the service.

You are still responsible for paying the remaining balance even if you fail to show up or choose to forgo the service, unless you have exercised your right of withdrawal as outlined in section 6 below.

5. Conclusion of Sales

Online Purchase

To purchase a Partner’s offer, you must complete the purchase process available on the Site and make the payment via PayPal, either for the full price or a deposit.

As soon as PayPal confirms the payment, the Site initiates real-time automated procedures that ensure:

• The sending of a confirmation email to your email address, containing a summary of the general and specific terms applicable to the contract, details on the essential features of the offer, the indication of the price and/or deposit paid online, and any remaining balance still to be paid;
• The sending of a notification email to the Partner as further confirmation of the online sale of the purchased offer and its essential details.

Sales completed in this manner take effect exclusively between you and the Partner. calabria-tour.it, being solely responsible for managing the Site and its e-commerce platform, remains uninvolved in the online sale of the offer.

Purchase via Customer Service

You can purchase offers from our Partners via PayPal. You will be redirected to a dedicated web page to complete the payment for the full price or a deposit.

As soon as we receive payment confirmation, we will send a confirmation email to your email address with a summary of your purchase. We will also notify the relevant Partner of the completed sale.

Sales completed in this manner take effect exclusively between you and the Partner. calabria-tour.it, solely managing the Site and assisting Clients, remains uninvolved in the sale (both online and offline) of the offer.

6. Right of Withdrawal and Modifications

Each Partner’s withdrawal policies are indicated on the web pages hosting their offers. If you decide to cancel your purchased offer, we invite you to notify the Partner as soon as possible: this will help avoid unnecessary financial loss for our Partner and prevent you from having to pay the full price of the purchased offer despite not using it.

In case of a “no-show” or cancellation beyond the last deadline for withdrawal, your obligation to pay the remaining balance in full remains in force. You may communicate your withdrawal using the Site’s digital services (only for Online Purchases) or by directly contacting the relevant Partner.

Depending on each Partner’s specific withdrawal conditions, your cancellation may be subject to penalties up to and including full payment of the remaining balance. The application of such penalties is entirely at the discretion of the Partners.

The deposit paid towards the total price of the offer during the purchase process is under no circumstances refundable and must therefore be considered NON-REFUNDABLE.

Any modifications to your preferences and/or details provided at the time of purchase must be requested directly from the relevant Partner, who alone can accept or refuse them based on their sales policies and independent business decisions.

7. Proof of Orders and Storage

The data related to completed sales on the Site is regularly stored in the calabria-tour.it database and has the same probative value as all written documents.

8. Price Indication

The prices displayed on the Site apply to the entire use of the offer as described on the Site and include VAT. A crossed-out price indicates an ongoing promotion.

calabria-tour.it, also by virtue of specific agreements signed with its Partners, always strives to offer the lowest price available on the market. We therefore invite you to inform us should this not be the case.

9. Liability

calabria-tour.it is not a contractual party in the sale of Partner offers and, consequently, cannot be held liable for any contractual or non-contractual damages suffered by third parties in relation to the services provided by the Partners. It is also not responsible for the correct execution of the services included in the offers, which remain the sole responsibility of the respective Partners.

Both calabria-tour.it and its Partners are committed to fulfilling their respective obligations with diligence and professionalism, and each party is exclusively responsible for its own duties. Consequently, calabria-tour.it’s liability is strictly limited to correctly managing the sales process in accordance with the pricing, rates, and availability details provided by the Partners. These details remain entirely and exclusively under the responsibility of our Partners.

calabria-tour.it has no control over the quality, safety, or legality of the commercialized offers and does not guarantee the accuracy or truthfulness of the information provided by the Partners. Therefore, it cannot be held liable for any errors (including obvious or typographical mistakes) or misleading, inaccurate, or false information.

It is the Partner’s duty to ensure that its Clients receive adequate information and any additional communication necessary for the proper use of the purchased offer.

calabria-tour.it is not responsible for technical malfunctions or third-party interventions that may partially or completely affect the functionality of the Site. Furthermore, it does not guarantee continuous and uninterrupted access to the Site and its services, as these may be subject to factors beyond its control.

calabria-tour.it also reserves the right to temporarily suspend its services (in whole or in part) at any time, for reasons including, but not limited to, technical maintenance, updates, or platform improvements. As a user of the Site, you acknowledge that calabria-tour.it cannot be held liable—neither to you nor to third parties—for any suspension or interruption of its services and/or the Site.

Additionally, calabria-tour.it is not responsible for the processing of your personal data by the Partners, who operate independently and with full autonomy from calabria-tour.it.

The liability of calabria-tour.it and its Partners is excluded in all cases where the non-fulfillment or improper execution of a service is attributable to the offer beneficiary. Examples include, but are not limited to:

• Failure to show up or arrival after the grace period allowed by the Partner and stated on the Site;
• Failure to comply with the Partner’s sales conditions;
• Refusal to sign a liability waiver required for activities involving particular risks;
• Refusal or inability to prove identity with a valid identification document.

10. Copyright and Intellectual Property Rights

The Website may only be used for viewing and purchasing offers. Visitors to the Website are prohibited from any form of reproduction, modification, duplication, copying, distribution, sale or other commercial exploitation of the Website and/or its offers, unless expressly authorized in writing by calabria-tour.it. Travel agencies and tour operators that may be interested in obtaining authorization can easily contact calabria-tour.it at info[at]calabria-tour.it indicating the subject “authorization”. Similarly, facilities and/or operators interested in becoming Partners (including travel agencies and tour operators) may contact calabria-tour.it at the same address indicating the subject “affiliation”.

It is permissible to download or print a copy of the materials contained on the Website for personal or business use and not for profit. Unauthorized use of the Website and the material contained therein constitutes a violation of the intellectual property rights of calabria-tour.it or third parties who have provided a license.

calabria-tour.it is the exclusive owner of the calabria-tour.it® trademark and the calabria-tour.it domain. The user agrees to retain all trademark and copyright notices contained on downloaded or copied materials. Use of these materials on any other website is prohibited, unless expressly authorized in writing by calabria-tour.it.

Any use of the services offered for fraudulent purposes or for the sole purpose of damaging calabria-tour.it and/or its Partners is also prohibited.

Users expressly acknowledge that all information, texts, data, know-how, source codes, algorithms, models, databases and the like, distinctive signs of the Website or part thereof (logo, icons, etc.), relating to the offers and the Website, remain the exclusive property of calabria-tour.it and/or its Partners and/or third parties who have provided them.

calabria-tour.it grants users of the Website a personal, non-transferable and non-exclusive license to use its services on a single computer in accordance with these General Conditions and exclusively for the duration of the contractual relationship governed by them, it being understood in any case that users may not copy, modify, sell, assign, sublicense, confer or transfer to third parties or create derivative works from any right of calabria-tour.it, nor allow third parties to do so directly or through their computer, even without their knowledge.

Users are in no way authorized to link the Website to other websites, unless prior written authorization has been granted by calabria-tour.it.

11. External Sites and Disclaimer of Liability

calabria-tour.it disclaims all liability for the accuracy and content of external sites/resources linked to the Site, and assumes no responsibility for the content and/or material, including advertising, disseminated on such external sites or resources or for the products and services offered therein. Such products and services cannot be considered in any way sponsored, shared or supported by calabria-tour.it, therefore you assume full responsibility for any purchases made of said products and services. You also acknowledge and agree that calabria-tour.it cannot be held responsible in any way for the operation of such external sites/resources.

12. Changes to the General Conditions

calabria-tour.it reserves the right to modify these General Conditions at any time, it being understood that your order is governed by the General Conditions in force at the time the order is placed.

13. Privacy and Processing of Personal Data

calabria-tour.it treats the personal data you provide with the utmost care in accordance with the law and with the highest ethical standards. To purchase the offers on the Website, you must enter your name (first and last name) and a valid email address. You assume exclusive responsibility for any use of the services offered by the Website made through your email address, and you agree to indemnify and hold harmless calabria-tour.it from any damage or claim arising from their use and/or misuse. You declare, in accordance with the provisions of Legislative Decree 196/2003, that all the information provided at the time of registration is truthful, complete and accurate. You have the right to request from the data controller at any time the complete and updated list of the subjects to whom personal data may be communicated.

The data relating to your credit card, necessary to complete the purchase of the Partners’ offers, are in no way stored by the calabria-tour.it information system, but are directly and exclusively managed by the PayPal information systems, whose payment services calabria-tour.it uses.

The data controller is calabria-tour.it. The data controller, in using manual, IT and telematic tools for the processing of personal data, adopts all appropriate measures to ensure their security and confidentiality, in accordance with the provisions of Legislative Decree 196/2003.

calabria-tour.it processes your personal data to:

• fulfill the obligations (sending purchase confirmation emails, sending your name and email to Partners to allow them to identify you or your contact person and to allow them to fulfill their tax obligations) arising from the contract between it and its Partners and necessary for the conclusion of the contract between you and the Partner proposing the offer you purchased;
• respond to your requests regarding our services;
• send newsletters (with your prior consent);
• carry out quality checks (e.g. surveys) of the services provided by the Partners (with your prior consent).

Calabria-tour.it also reserves the right to monitor web traffic on its Website. In doing so, we may collect, use and process data and information of various kinds (e.g. IP address, UDI identification code for visitors using a mobile device, geographical origin of web traffic and other data deriving from the application of “web-analytics” techniques), which in any case will be strictly anonymous, non-confidential and non-personal.

calabria-tour.it offers the possibility, to registered users only, to express comments on the offers of its Partners. These comments are visible to all users of the Website, therefore, by deciding to express a comment, you agree that the name you have indicated will be disclosed. calabria-tour.it reserves the right not to publish or to remove your comment if it contains offensive expressions or is contrary to the decorum of the Website.

calabria-tour.it may contact you to ask you to express a comment following the use of an offer purchased on the Website.

Each registered user has the right to access their personal data and all the rights provided for by Article 7 of Legislative Decree 196/2003, the content of which is reproduced below.

14. Rights of the Interested Party: Right of Access to Personal Data and Other Rights

3. The interested party has the right to obtain:  

a. the updating, rectification or, when interested, the integration of data; b. the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those for which conservation is not necessary in relation to the purposes for which the data were collected or subsequently processed; c. the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case where such fulfillment proves impossible or involves a manifestly disproportionate use of means with respect to the protected right.

16. Applicable Law and Dispute Resolution

These General Conditions and the relationship between you and calabria-tour.it are governed by Italian law. calabria-tour.it and its Partners consider the achievement of full satisfaction of their visitors and Customers a priority objective of their management, and declare their common willingness to promptly remedy any shortcomings for which they are actually responsible. In this same perspective, should the event occur, you are required to attempt the mandatory conciliation, to be carried out electronically, in compliance with the specific procedures provided for by art. 5, paragraph 5 of Legislative Decree 28/2010.

The original Italian language text of these General Conditions has been translated into other languages. The translated version is unofficial and intended to assist foreign users of the Site, therefore it has no legal value. In case of disputes or inconsistencies or discrepancies between the Italian text and the translated text, the Italian text prevails and constitutes the sole reference that can be appealed in legal terms. The Italian text can be consulted by selecting the Italian language on the Site.
